Overview
Welcome to THE URAh. This website and store, "THE URAh" (including all related information, content, features, tools, products, and services; the "Services"), is operated by Olive Tree Inc. (COCON KARASUMA 3F, 620 Suiginya-cho, Shimogyo-ku, Kyoto 600-8411, Japan; "we," "us," or "our"). The Services are powered by Shopify, which enables us to provide them to you.
These Terms of Service, together with the policies referenced in them (collectively, the "Terms"), set out your rights and responsibilities when you use the Services.
These Terms contain important information about your legal rights, including information about warranties and the scope of our liability. Please read them carefully.
By visiting or using the Services, you agree to these Terms and to our Privacy Policy [link]. If you do not agree to these Terms or the Privacy Policy, please do not use or access the Services.
1. Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your country, state, or region of residence, and that if you allow a minor dependent to use the Services on a device you own or control, you consent to and are responsible for that use. If you are a minor, please use the Services to make a purchase only with the consent of a parent or guardian.
To use the Services, including browsing our online store or making a purchase, we may ask you to provide certain information, such as your email address, billing and shipping addresses, and payment information. You represent and warrant that all information you provide to us is accurate, current, and complete, and that you have the right to provide it.
You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.
2. Our Products
We make every effort to represent our products accurately in our online store. However, depending on your device and display settings, colors and the appearance of products may differ from the actual items.
Our products are made of wool, cowhide leather finished with layered urushi lacquer (Kurozan leather), and a jacquard-woven lining. Kurozan leather carries the marks of the original hide, including scars and insect bites, and each hide differs in its grain and the luster of its lacquer. Due to the nature of the materials and the handwork involved in each jacket, color and texture may vary, and measurements may vary by about 1 cm from the values listed in the size chart. These are characteristics of the product, not defects.
Product descriptions may change at our discretion without notice. We reserve the right to discontinue any product at any time, and we may limit the quantities of products we sell to any person, region, or jurisdiction.
3. Orders
When you place an order, you are making an offer to purchase. A contract is formed when we confirm our acceptance of your order. We may decline to accept an order. Before accepting your order, we need to receive and process your payment (payment is taken when you place your order). If we do not accept your order, we will refund any payment received in full.
Cancellations, returns, and exchanges after an order is placed are governed by our Returns & Refunds Policy [link]. Please review your order details, including size and lining color, carefully before submitting it.
If we do not accept, or if we change or cancel, an order, we will notify you using the email address, billing address, or phone number you provided with your order.
You represent and warrant that your purchases are for your own personal use and not for commercial resale.
4. Prices and Billing
Prices are subject to change without notice. The price charged for a product is the price in effect at the time your order is placed, as shown in your order confirmation email. The extent to which taxes, shipping, and duties are included in the price is governed by what is displayed at checkout and by our Shipping Policy [link].
Prices displayed in our online store may differ from prices in other regions or channels. If a promotion we offer has its own terms, those terms will apply where they conflict with these Terms.
You agree to provide current, complete, and accurate purchase and payment information for all purchases made at our store, and to promptly update your account and other information, including your email address and payment card details, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the payment card information you provide is true, accurate, and complete; (ii) you are duly authorized to use that payment method for your purchase; (iii) charges incurred by you will be honored by your payment card company; and (iv) you will pay the charges incurred by you at the posted prices (the treatment of shipping, duties, and taxes is governed by what is displayed at checkout and by our Shipping Policy [link]).
5. Shipping and Delivery
We expect to deliver your order within the timeframe stated on the product page and in our Shipping Policy [link]. Season One orders begin shipping in late November 2026. If orders for a particular color and size exceed the jackets completed that month, those orders will be fulfilled from the spring 2027 production run. How such orders are handled is governed by our Shipping Policy and our Returns & Refunds Policy.
All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events beyond our reasonable control. This section does not limit any rights you may have under applicable law.
Title and risk of loss pass to you when the product is delivered to you. All deliveries require a signature upon receipt.
6. Intellectual Property
Our Services, including but not limited to all trademarks, brands, text, images, graphics, video, and audio, and their design, selection, and arrangement, are owned by us, our affiliates, or our licensors and are protected by the copyright, trademark, and other intellectual property laws of Japan, the United States, and other countries.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, store, or transmit any of the material on our Services without our prior written consent, except to the extent permitted by copyright law or other applicable law. Except as expressly provided in these Terms, nothing in these Terms grants or shall be construed to grant a license or other rights to you under any patent, trademark, copyright, or other intellectual property of ours, Shopify's, or any third party's. All rights not expressly granted here are reserved by us.
The THE URAh name, logo, product names, designs, and slogans are trademarks of ours or our affiliates or licensors. You may not use these trademarks without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks appearing on the Services are the trademarks of their respective owners.
7. Optional Tools
As part of the Services, you may be given access to tools provided by third parties that we neither monitor nor control. These tools are provided by those third parties, and we do not make any warranty regarding their content or operation. Your use of such tools is at your own discretion, and you should review the terms of the relevant third-party providers. This section does not exclude our liability for our willful misconduct or gross negligence.
Any new features offered through the Services in the future will also be subject to these Terms.
8. Third-Party Links
The Services may contain links to websites provided or operated by third parties. We do not make any warranty regarding the content or accuracy of third-party sites you access. Any purchase or use of third-party products or services is a transaction between you and that third party, and you should review the third party's policies before engaging in any transaction.
9. Relationship with Shopify
The Services are powered by Shopify, which enables us to provide them to you. However, all sales and purchases in our store are made directly with us. We, not Shopify, are responsible for the sale, including any damage arising from products you purchase.
10. Privacy Policy
All personal information we receive through the Services is subject to our Privacy Policy [link], and certain personal information may be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. 11. Feedback
If you submit, post, or otherwise provide ideas, suggestions, feedback, reviews, or other content to us ("Feedback"), you grant us permission to use, reproduce, modify, publish, distribute, and display that Feedback, free of charge and in any media, for the purposes of improving and presenting our products and services. We will obtain your consent in advance before using your name or photograph in our advertising.
You represent and warrant that (i) you have all necessary rights to your Feedback, and (ii) you will disclose any compensation or incentives you received in connection with your Feedback. We are not obligated to keep any Feedback confidential, to pay compensation for it, or to respond to it.
We may, but are not obligated to, monitor, edit, or remove Feedback that we determine to be unlawful, offensive, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property or these Terms. You agree that your Feedback will not violate any third-party rights, including copyright, trademark, privacy, or personality rights, and will not contain unlawful, abusive, or obscene material or malware. You may not use a false email address, impersonate anyone, or misrepresent the origin of any Feedback.
12. Errors, Inaccuracies, and Omissions
Information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, shipping charges, delivery times, availability, and other matters. We may correct such errors and change or update information without notice. If a price is displayed in obvious error, we may cancel orders placed based on that error, including after an order has been submitted. In that case, we will notify you promptly and refund any payment received in full.
13. Prohibited Uses
You may use the Services only for lawful purposes. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, defame, threaten, or harm others; (e) to submit false or misleading information; (f) to send, receive, or use any material that does not comply with these Terms; (g) to send spam or other solicitations or advertising; (h) to impersonate any person or entity; or (i) in any way that could interfere with the use of the Services or create damage or liability for us, Shopify, or other users.
In addition, you may not: (a) upload or transmit viruses or other malicious code; (b) reproduce, extract, sell, resell, or commercially exploit all or any part of the Services; (c) collect or track the personal information of others; (d) engage in spam, phishing, fraud, or impersonation; (e) access the Services using robots, scrapers, data collection or extraction tools, automated means, or AI tools (including agentic AI) except in compliance with Section 14; or (f) interfere with or circumvent any security features or access restrictions. If we determine that you have violated these Terms, we may suspend or delete your account.
14. Agents
14.1 This section applies if you use, authorize, or deploy software or a service that acts autonomously or semi-autonomously on behalf of a person or entity without direct supervision (an "Agent") to access, use, or interact with the Services.
14.2 An Agent may not access, use, or interact with the Services unless it always identifies itself and operates in strict compliance with the requirements in Section 14.4. If we ask an Agent to refrain from accessing or otherwise using the Services, the Agent must comply.
14.3 We may restrict whether and how Agents access or otherwise use the Services, including through technical means.
14.4 An Agent must: (i) disclose that it is an Agent by including the user agent string "Agent/[agent name]" in every HTTP/HTTPS request; (ii) not conceal that it is an Agent by mimicking human behavior or circumventing CAPTCHAs or similar measures; (iii) answer honestly any question asking whether it is a human or a computer; and (iv) not circumvent any measures used to control access by Agents.
15. Termination
We may terminate your access to all or part of the Services if you violate these Terms or if we otherwise determine it necessary. Even in that case, orders that have already been formed will be handled in accordance with these Terms and our policies. You remain responsible for any amounts owed up to the date of termination.
Provisions relating to intellectual property, Feedback, termination, warranties, the scope of liability, liability for damages, severability, waiver and entire agreement, assignment, governing law, the Privacy Policy, and any other provisions that by their nature should survive will survive termination.
16. Warranties
Information provided on the Services (other than descriptions of our products and services) is for general information purposes. We do not warrant that your use of the Services will be uninterrupted, timely, secure, or error-free.
If a product we sell does not conform to the contract in kind, quality, or quantity, we will respond by repair, replacement, or refund in accordance with applicable law and our Returns & Refunds Policy [link]. Individual variations arising from the materials and methods described in Section 2 do not constitute non-conformity.
Nothing in these Terms, including this section, limits any rights you have under mandatory consumer protection laws that apply to you.
17. Scope of Liability
If you suffer damage due to our willful misconduct or gross negligence, we will compensate you for that damage in accordance with applicable law.
If you suffer damage due to our negligence (other than gross negligence), we will compensate you only for direct and ordinary damage actually incurred, up to the amount paid for the order that gave rise to the damage.
The preceding paragraph does not apply in cases of our willful misconduct or gross negligence. This section also does not apply to any damage for which liability cannot be excluded or limited under mandatory consumer protection laws or other applicable law.
18. Your Responsibility
If your violation of these Terms causes damage to us, Shopify, or any other third party, you will be liable for that damage in accordance with applicable law.
19. Severability
If any provision of these Terms, or any part of a provision, is found to be invalid or unenforceable under consumer protection law or other applicable law, the remaining provisions of these Terms will continue in full force and effect.
20. Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
These Terms and any policies we post on the Services constitute the entire agreement between you and us regarding your use of the Services, and supersede any prior agreements, communications, and proposals, whether oral or written (including prior versions of these Terms).
21. Assignment
You may not delegate, transfer, or assign your rights or obligations under these Terms without our prior written consent. We may transfer our position, rights, and obligations under these Terms to a transferee in connection with a business transfer or similar event. In that case, we will notify you.
22. Governing Law and Jurisdiction
These Terms and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of Japan. The Kyoto District Court shall have exclusive jurisdiction in the first instance over any dispute arising out of or relating to these Terms or the Services.
However, if you are a consumer, this section does not deprive you of any rights granted to you under the mandatory laws of your country or state of residence (including consumer protection laws), or of any jurisdiction available to you under applicable law.
23. Headings
The headings used in these Terms are for convenience only and do not affect the interpretation of these Terms.
24. Changes to These Terms
We may change these Terms where (1) the change is in the general interest of our customers, or (2) the change does not conflict with the purpose of the contract and is reasonable in light of the need for the change, the appropriateness of the new terms, the nature of the change, and other relevant circumstances.
If we change these Terms, we will notify you, before the change takes effect, that the Terms are being changed, of the content of the revised Terms, and of the date they take effect, by posting on this website or by other appropriate means. The current version of these Terms is always available on this page.
